Clerk and Recorder’s Office Adjusts Policies to Help Victims of Black Forest Fire
[Colorado Springs, Colo. – June 18, 2013] In an effort to provide relief to victims of the Black Forest Fire, the Clerk and Recorder’s Office is temporarily changing some policies for those who have lost or had to evacuate their home. “We are waiving fees for those who lost vital documents in the fire. If you’re worried about replacing your home, you shouldn’t have to worry about paying fees to replace documents like your marriage license and vehicle titles,” stated Clerk and Recorder Wayne Williams. “Our hearts go out to all those affected by the fire. We have worked with the State to implement other policy changes to help those impacted by the fire. It is my sincere hope that these changes will bring some measure of comfort to those affected by this tragedy.”
Victims of the Black Forest Fire will find the following changes in the Clerk and Recorder’s Office:
Recording Department
No fees will be charged for replacement copies of marriage licenses, deeds, or any other applicable documents for fire victims. This change will be in effect through August 31, 2013.
Motor Vehicle
No fees will be charged for replacement copies of driver’s licenses, vehicle registration, titles, duplicate tags, or any other applicable documents for fire victims. This change will be in effect through August 31, 2013.
If a vehicle’s registration lapsed in May, the “grace period” for avoiding the late fee will be extended from June 30th to July 15th. This change will be in effect for all those in any evacuation zone, regardless of whether they experienced a home loss.
If a vehicle registration fee was paid between May 12 and June 12 and the vehicle was destroyed by the fire, the owner can get a full refund of their vehicle registration fee through July 15, 2013.
If a vehicle was destroyed by the fire but was registered before May 12, the owner may get the amount paid for their registration credited towards the registration fees of a replacement vehicle.

Liquor licensed businesses affected by the fire can call (719) 520-6430 for individualized information.
Elections
Those who experienced a home loss should expect a letter from the Elections Department regarding their voter registration options in advance of the November 2013 Coordinated Election.
In an effort to ensure that only those victims of the Black Forest Fire receive these special services, our staff will work to verify the victim’s address against the El Paso County Sheriff’s database of homes lost in the fire and those in the evacuation zone. However, we recognize that the Sheriff’s database is not currently all inclusive, and our staff will work to resolve any issues regarding this on an individual basis. If a fire victim is in need of additional services from the Clerk and Recorder’s Office that has not been addressed, we ask that they bring it to our attention immediately by calling (719) 520-7322.

Clerk and Recorder to Serve as DEO for Monument Area Metro District Recall
[Colorado Springs, Colo. – May 24, 2013] The El Paso County Clerk and Recorder’s Office approved as to form separate recall petitions for two members of the Village Center Metropolitan Board, a district located in the Monument area. Starting May 25, 2013, recall organizers have 60 days to gather 102 signatures to recall each respective board member Bruce Hacker and Steven Barr.
Due to the changes to Colorado State law made in House Bill 13-1303, Clerk and Recorder Wayne Williams will serve as the Designated Election Official (DEO). Clerk and Recorder Williams’ Office will be responsible for printing and mailing of ballots, as well as establishing the four Voter Service and Polling Centers mandated under the new law to serve the 254 eligible electors that make up the Village Center Metropolitan District. The Clerk and Recorder’s Office has estimated the cost of this potential recall election for this district to be $3,422.41, a cost that will be charged to the Village Center Metropolitan District, and not the taxpayers of El Paso County. “It is disappointing that the State increased the costs of recall elections by enacting HB13-1303 on a party-line vote,” noted Clerk and Recorder Wayne Williams, who testified against the legislation because of the cost increases.
“Should the recall organizers gather the necessary number of signatures to recall one or both board members, I am confident that my able staff will run a fair and efficient election given the changes to the law,” stated Williams. “Our Elections Manager Liz Olson and her staff are well qualified to provide the services now required to run this election.”
It also should be noted that the language included on the recall petition forms approved by the Clerk and Recorder’s Office should not be viewed as supporting or refuting the allegations contained in the recall petition forms.

School District 11 Recall Efforts Cease Due to Lack of Signatures
[Colorado Springs, Colo. – May 6, 2013] Efforts to recall six members of the School District 11 Board of Education ceased today due to lack of signatures. Recall organizers had until 5:00 PM today to submit 15,000 signatures to continue the process of recalling the six targeted members. If the recall organizers wished to try again, they would need to restart the entire process.
“Our Elections Department staff, led by Elections Manager Liz Olson, did an outstanding job handling this process,” stated El Paso County Clerk and Recorder Wayne Williams. “Had this process moved forward, I have no doubt that my office would have conducted a clean and fair election.”
Had the recall efforts advanced, the election would have been conducted under the potentially new regulations outlined in House Bill 13-1303, which mandates all mail ballots, removal of neighborhood polling locations, and additional costs to conduct an election. “Had the recall efforts progressed with this House Bill in place, it would have cost School District 11 more money that would be better spent on educating our children. It is disappointing that House Bill 13-1303 will take money away from a school district’s budget to pay for the increased cost of elections,” said Williams.

Clerk and Recorder Offices Close Early Due to Weather
Urgent, for Immediate Release
[Colorado Springs, Colo. – April 17, 2013] Due to the winter storm system hitting El Paso County, the Clerk and Recorder’s Office will be closed as of 4:00 PM MST. This closure will affect primarily any citizens attempting to register vehicles at any of our four locations.
“In coordination with other county officials, we have made this decision out of concern for both our customers and staff that have to negotiate deteriorating road conditions. We remain committed to providing exceptional customer service to the citizens of El Paso County and hope to intercept anyone en-route to one of our locations for any service,” stated Clerk and Recorder Wayne Williams.
At this time, it is anticipated that the Clerk and Recorder’s office will be operating under normal business hours on Thursday April 18th, 2013. Clerk and Recorder Releases Video Outlining Concerns with Election Re-Write
Promotes Awareness of Bill’s Costs and Problems
[Colorado Springs, Colo. – April 15, 2013] In an effort to educate the public about serious problems with the costly and radical elections re-write bill (HB 13-1303) introduced in the Colorado General Assembly last week, Clerk and Recorder Wayne Williams has released a YouTube video that draws attention to several key flaws in the bill.
“The more the people of the State of Colorado and El Paso County learn about this terrible piece of legislation, the more they don’t like it. By releasing this video, it is my intent to draw attention to several key shortcomings. This bill increases the likelihood of dirty elections. The practices currently in place that detect fraud would not be able to be applied with same day voter registration.”
In the video, Clerk and Recorder Williams outlines how the statewide elections system SCORE would not instantly flag a potential duplicate registration unless a person seeking to register and vote multiple times provided accurate and honest information-a rather unlikely scenario. Williams also points to a 2012 case of attempted voter fraud that would not have been caught with same day voter registration.
“I am wholly committed to the conduct of fair and clean elections. The more we learn about this bill the more concerned we become it will undermine our strong and successful system,” Williams stated.

Clerk and Recorder Warns of Issues with Late Elections Bill
Encourages Awareness of Bill’s Costs and Problems
[Colorado Springs, Colo. – April 8, 2013] El Paso County Clerk and Recorder Wayne W. Williams today expressed concern over a radical and costly elections rewrite expected to be introduced this week at the Colorado General Assembly. The late bill strips voters of neighborhood voting, forces mail ballot delivery on voters who don’t want it, prescribes unnecessary numbers of expensive voting service centers, requires the perpetual mailing of ballots to voters who may have moved, and permits risky same-day voter registration, among other things.
“I want to make sure people understand that all county clerks do not support this bill. I am concerned about the integrity of the election system and preserving voter choice,” said Williams. Colorado’s most-populous county, El Paso County, is not a member of the private group known as the Colorado County Clerks Association (CCCA). “I strongly oppose many of the issues in the draft bill. I’m concerned people will take for granted clerk support because one group may be in support,” explained Williams.
According to Williams, cost estimates related to the bill’s mandates are staggering. “I asked my office to estimate the cost of making the changes in this rewrite. Net cost increases from this bill in El Paso County will be $695,900 in 2014,” Williams explained.
Colorado had the third-highest voter turnout in the nation in 2012, and Williams encourages legislators to approach wholesale changes to a proven election system carefully. “It would be wise to ask, ‘What problems are we trying to solve?’ Often, complaints about elections are easily remedied through a business approach to government processes that places higher value on positive customer service. Many such improvements can be made by county commissioners and county clerks at the local level who are directly responsible to the voters. Improvements don’t require a heavy-handed, top-down, legislative approach of one size fits all. Further, any suggested ‘improvements’ to our state’s election system ought to be judged on whether or not the intended outcome will result in greater system integrity, and accompanying greater voter confidence.”

Chris Myszkowski Chosen Motor Vehicle Manager
for El Paso County Clerk & Recorder’s Office
[March 25, 2013 – Colorado Springs, Colo.] – A retired US Air Force officer with years of government and private sector experience has been chosen to lead the El Paso County Motor Vehicle Department. Clerk & Recorder Wayne Williams announced today that Chris Myszkowski (say: mish-KOV-ski) will join his office as motor vehicle manager, effective April 1.
Myszkowski, who is currently operations manager in El Paso County’s Department of Human Services, will bring valuable knowledge of County structure as he transfers to the Clerk & Recorder’s Office. In his new position as head of a statutory department, he will be responsible for the four branch Motor Vehicle offices. All motor vehicle transactions including vehicle registration and titling and driver’s license renewals are handled at the County offices.
Williams emphasized Myszkowski’s background in public service and developing effective operational programs that will strengthen the Motor Vehicle Department. He was selected from a deep pool of exceptionally qualified candidates. Applicants represented diverse fields with some being internal to County government and others coming from external organizations.
Williams noted that the interview process included representatives from two automobile dealers in Colorado Springs. “Customer service is the essence of what we do. I wanted to make sure that our customers were represented in the selection process,” he said.
One of the auto dealer representatives, Ray Reilly, spoke of the process. “I would like to thank the County for asking the auto dealers to participate in the interview process for a DMV manager. The relationship we have with the county is very important and I was impressed with the amount of time and dedication that was put into selecting the right person. I believe Mr. Myszkowski will do a phenomenal job for the County and the auto dealers and our relationship will continue to remain strong. “
Williams mentioned Myszkowski’s qualifications. “Chris has the strategic skills, along with insightful interpersonal skills, to manage the challenges and complexities of the Motor Vehicle Department. He will provide customers with the level of professional service they deserve. We have a strong staff at all locations and Chris’ ability for analytical development will further support the work of our team.”
A self-described “trouble-shooter” with expertise in education and administrative management, Myszkowski served as dean of DeVry University and Keller Graduate School of Management in Colorado Springs. He also was executive director of Catholic Charities of Colorado Springs. Myszkowski had previous experience in El Paso County as deputy director/fiscal officer (interim executive director) for the Department of Health and Environment.
“Joining the Clerk & Recorder’s Motor Vehicle Department gives me the opportunity to continue serving the public,” said Myszkowski. “Motor Vehicle’s services are nearly essential to our citizens and it will be rewarding to be part of the team that provides these services with an effective, professional operation.”
Myszkowski holds a Master’s Degree in Education/Educational Psychology from the University of Oklahoma and a Bachelor’s Degree in Sociology/Social Work from Central Connecticut State College. He has continued educational endeavors with the Center for Creative Leadership, Chamber Nonprofit Management Leadership Institute and Leadership Rapid City (S.D.). He has published articles on topics including organizational development, healthcare, stewardship, poverty and homelessness, and has appeared as a speaker at seminars and symposia.

County and City Clerks’ Offices Collaborate on City Election
[March 15, 2013 – Colorado Springs, CO] – For the first time in local elections, the County Clerk & Recorder’s Office is serving as an official drop-off location for ballots in the Colorado Springs General Municipal Election. There also will be a County election senior specialist at the City Clerk’s Office the week prior to the April 2 Election to handle voters’ change of addresses.
County Clerk & Recorder Wayne Williams and City of Colorado Springs Clerk Sarah Johnson agreed a collaborative effort of the two government entities would facilitate the voting process for citizens. Their objective was to combine the resources of both offices to better serve the voters in exercising their democratic right to vote.
In addition to the City’s ballot drop-off locations, the main office and three branch offices of the County Clerk & Recorder have ballot boxes for voters to drop off their ballots. At the County’s Citizens Service Center, there is a 24-hour, drive-up ballot box in front of the building, where voters can conveniently drop off their ballot from their vehicle at any time. Office locations and hours are shown below. All County offices will be open on Election Day 7 a.m. -7 p.m. for the election.
Voters who need to update their registration or change their address may do so online at www.govotecolorado.com through Tuesday, March 26. Beginning March 27, voters may visit the City Clerk’s Office where a County election senior specialist will assist them with changes. The specialist will work at the City Clerk’s Office through Election Day, April 2.
Voters also can update their information by using a voter registration form and emailing it to elections@elpasoco.com, faxing it to 719-520-7327 or mailing it to the County Clerk & Recorder. The form is available at http://car.elpasoco.com/Election or at www.govotecolorado.com . All changes after March 26 should be made in person at the City Clerk’s Office.
Ballots are being issued only at the City Clerk’s Office, 30 S. Nevada. Voters with questions or concerns should contact the City Clerk’s Office, (719) 385-5901 (option 1) or email election@springsgov.com.
County Clerk & Recorder ballot drop-off locations are open Monday – Friday, 8 a.m. – 5 p.m. The North Office also is open Saturday, 8 a.m. – 1 p.m.

El Paso County Clerk and Recorder Approves D11 Recall Petitions for Circulation
(March 7, 2013 – Colorado Springs, Colo.) –El Paso County Clerk and Recorder Wayne Williams approved as to form petitions submitted to recall six of seven Colorado Springs School District 11 Board of Education Directors (Nora Brown, Al Loma, LuAnn Long, Sandra Mann, Elaine Naleski, and Jan Tanner). The Recall Committee may now circulate the petitions for no more than 60 days. A minimum of 15,000 verified petition signatures are required for each of the petitions.
Petitions were initially submitted on Feb. 28 and, after review, were disapproved as to form on March 4. The Recall Committee members, including Mariam Kurvink, Elaine Shoemaker, and Dorothy Dykes, submitted revised petitions March 5.
The Clerk & Recorder is the Designated Election Official (DEO) in school board recalls. Recall petitions are submitted to the Clerk and Recorder’s Office for approval as to form. The Clerk’s Office has until the close of the seventh business day following submission to approve or disapprove a petition for circulation.
Once the DEO receives a signed petition, it is reviewed and verified against the registration records. The petition review must be completed no later than 15 business days after the initial filing of the petition. If the petition is deemed sufficient, a 15-day protest period begins. If a protest is filed, a hearing is set and is heard by the DEO. The hearing shall be concluded within 30 days after the protest is filed.
If the recall petition’s sufficiency is sustained, a date for the election is set. The recall election date shall be from 45 days to 75 days after the recall petition has been deemed sufficient and the time for protest has passed. Nomination petitions for successor candidates may be circulated beginning the first date on which a protest may be filed and must be filed no later than 10 calendar days after the DEO sets the election date. Nomination petitions are taken out at the office of the DEO.
The timeline below for the recall process shows estimated dates only. All dates are subject to change depending on when/if protests are filed, how many are filed and the length of time for the Clerk’s office to complete each step.
3/07/13 – Petition approved for circulation

5/06/13 – Last day to file petitions with Clerk & Recorder
5/28/13 – Petition review complete and notice of appearance of sufficiency or insufficiency issued

The school district is responsible for reimbursement to the Office of the Clerk & Recorder for reasonable expenses incurred in performing duties relating to the recall of an incumbent of the political subdivision. The 2006 recall election involving District 11 cost $256,729.22.

DRIVER’S LICENSE SERVICE UNAVAILABLE AT SOUTHEAST POWERS BOULEVARD LOCATION
March 5, 2013 – Colorado Springs, CO – El Paso County Clerk and Recorder Wayne Williams has reported a motor vehicle accident has damaged a T1 telecommunications line that supports driver’s license services at the organization’s Southeast Branch Office located at the corner of Powers Blvd. and Airport Rd. Driver’s license services will be unavailable at the Southeast Office until further notice. There is currently no time estimate for repair. All other motor vehicle services including vehicle registration, titling, etc. are available.
Individuals who need to renew their Driver’s License should visit the Main Office at Citizens Service Center, 1675 W. Garden of the Gods Road or the North Branch Office at 8830 N. Union. All office locations are open 8 a.m. – 5 p.m. Monday through Friday. The North Branch Office also is open Saturday, 8 a.m. – 1 p.m.

[March 4, 2013 – Colorado Springs, CO] – El Paso County Clerk and Recorder Wayne Williams has disapproved as to form all six recall petitions filed Feb. 28, 2013 against directors of the Colorado Springs School District 11 Board of Education, including Nora Brown, Al Loma, LuAnn Long, Sandra Mann, Elaine Naleski, and Jan Tanner. Williams today notified recall committee members and the subjects of the recall efforts of the findings after two working days of review. Committee members (Mariam Kurvink, Elaine Shoemaker, and Dorothy Dykes) may revise and resubmit the petitions for approval.
Williams explained, “The findings, while important, were relatively small issues we believe the committee can correct rather quickly. We anticipate the committee will return the petitions for ultimate approval to begin circulation for signatures. Our office works diligently to facilitate citizens’ rights as outlined by the State Constitution.”

John Leavitt Named Public Information Officer
for El Paso County Clerk & Recorder Wayne Williams
[March 4, 2013 – Colorado Springs, CO] – El Paso County Clerk and Recorder Wayne Williams today announced his office has hired John Leavitt, APR, as its new public information officer. Leavitt, a local public relations veteran, brings 19 years of government communications experience to the position.
“We are excited John has joined our team,” said Williams. “He will be charged with ensuring two-way communications to provide citizens with vital information from the Clerk and Recorder’s Office and to provide our management team with feedback from citizens for continuous improvement of our processes.”
Leavitt most recently served as a public relations consultant for Junior Achievement USA in Colorado Springs. Before that brief stop, Leavitt served in senior communications positions with The City of Colorado Springs, Memorial Hospital, Colorado Springs School District 11, and Colorado Springs Utilities. Leavitt was named the Best Government PIO in 2012 by one media outlet.
Leavitt said, “It is an honor to join a team charged with such important and fundamental tasks as election management, motor vehicle registration, issuing marriage licenses, and recording real estate transactions. Virtually every El Paso County citizen at some point does business with this office. It’s a tremendous responsibility to be charged with communicating for this organization.”
Williams said Leavitt was chosen from a deep and talented pool of applicants. His strong commitment to public access to information, existing relationships with local officials, and professional reputation with local media were among his strengths. “John’s long-time ownership of a small business [a local Sports Clips franchise] means he understands private enterprise and the struggles our citizens face,” noted Williams.
Leavitt lives in Colorado Springs with his wife, Susan. They are parents of six children and are expecting their first grandchild. Leavitt has a Bachelor of Arts in Public Relations from Brigham Young University and a Masters of Public Administration from UCCS. February 28, 2013 - This afternoon, El Paso County Clerk and Recorder Wayne Williams received six recall petitions for Directors of the District 11 Board of Education. The recall petitions were filed against the following Board Directors: Elaine Naleski, Nora Brown, Al Loma, Sandra Mann, Luann Long and Jan Tanner. The Recall Committee Members include: Mariam Kurvink, Elaine Shoemaker and Dorothy Dykes.
The Clerk & Recorder is the Designated Election Official (DEO) in school board recalls. A recall petition is submitted to the Clerk and Recorder’s Office for approval as to form. The Clerk’s Office has until the close of the seventh business day following submission to approve or disapprove a petition for circulation. Once approved, the petition may be circulated for no more than sixty days. A minimum of 15,000 petition signatures are required for each of the School District 11 Board Directors.
Once the DEO receives the signed petition, it is reviewed and verified against the registration records. The petition review must be completed no later than fifteen business days after the initial filing of the petition. If the petition is deemed sufficient, the 15 day protest period begins. If a protest is filed, a hearing is set and is heard by the DEO. The hearing shall be concluded within thirty days after the protest is filed.
If the recall petition’s sufficiency is sustained, a date for the election is set. The recall election date shall be from forty-five days to seventy-five days after the recall petition has been deemed sufficient and the time for protest has passed. Nomination petitions for successor candidates may be circulated beginning the first date on which a protest may be filed and must be filed no later than ten calendar days after the DEO sets the election date. Nomination petitions are taken out at the office of the DEO.
If the recall petitions received by the Clerk and Recorder were to be approved on March 1, 2013, and the maximum time was taken for each portion of the recall process, this is a tentative schedule for the process:
3/01/13 – Petition approved for circulation
4/30/13 – Last day to file petition with Clerk & Recorder
5/21/13 – Petition review complete and notice of appearance of sufficiency or insufficiency issued
6/05/13 – If petition is sufficient 15 day protest period ends on this day
6/14/13 – Last day to hold a hearing if protest filed on last day
7/12/13 – Final day for hearing decision
8/26/13 to 9/25/13 – If sufficiency sustained on last day, election date set between 45 and 75 days from 7/12/13
The School District is responsible for reimbursement to the Office of the Clerk & Recorder for reasonable expenses incurred by the County Clerk and Recorder in performing duties relating to the recall of an incumbent of the political subdivision. The 2006 recall election involving District 11 cost $256,729.22.

CLERK PUBLISHES RESULTS MAP FOR COUNTY QUESTION 5A-PPRTA EXTENSION
Tuesday, December 4, 2012 – Colorado Springs, CO – Today El Paso County Clerk & Recorder Wayne Williams released the results map for the Pikes Peak Rural Transportation Authority Question 5A. This map shows how each precinct voted, and the percentages. The PPRTA Question was passed with 79.5% of the votes cast with 199,156 voting in favor of the extension and only 51,339 opposing it.
“It’s interesting to note that the strongly Republican area of Briargate and the strongly Democratic area of Manitou Springs were both over 80% in favor of the PPRTA extension, which goes to show that the bipartisan support and cooperation that has consistently been demonstrated on the Board of the PPRTA mirrors our community’s bipartisan support for the PPRTA,” said Clerk Wayne Williams.

2012 GENERAL ELECTION RESULTS CERTIFIED
Wednesday, November 21, 2012 – Colorado Springs, CO – The El Paso County Election Department has completed the required canvass process to certify and finalize the 2012 General Election results. The canvass process is the official audit of the election results. The Canvass Board was made up of two members of each major political party and the County Clerk & Recorder. The canvass reported a total of 292,698 votes, a record for El Paso County, exceeding 2008’s total of 274,707 by 17,991.
Part of finalizing the election results is completing the required Post Election Audit. This audit is a comparison of the tabulated results to a hand count. The races and voting devices are randomly selected by the Secretary of State’s Election Division. El Paso County’s machine and hand count matched in every instance.
Additionally, UOCAVA ballots that were returned by Military and Overseas Citizens voters and were postmarked by Election Day were counted and added into the results. Other ballots that were included in the final count are ballots where the voter needed to cure their ballot before it could be counted. There are several reasons for this; for example their signature did not match their voter record, they needed to provide identification, or they did not sign their ballot. Individuals with these types of situations were notified by letter and had eight days after the election to respond and correct the problem in order to have their ballot counted.
The final step was reviewing 9,741 Provisional Ballots. Of these 8,454 (87%) were counted. The most frequent reasons for casting a Provisional Ballot were prior receipt of a Mail Ballot, moving, and going to the wrong polling place. In the Provisional review, all polling places reports and returned Mail Ballots were reviewed to ensure no voter was able to cast more than one ballot.
The final official results include 14,802 more ballots than the last unofficial results published Election Night. While some percentages changed slightly, the only result that varied was the El Paso County vote on Amendment 64. The counting of the additional ballots meant that El Paso County voters supported Amendment 64 by a margin of ten votes. Results from the rest of the state showed Amendment 64 passing already.

ELECTIONEERING RESTRICTIONS AT POLL PLACES
Friday, October 19, 2012 – Colorado Springs, CO – “100 Foot Limit” signs already are in place at the El Paso County Clerk & Recorder’s Offices. The signs warn the public that electioneering is prohibited within 100 feet of a polling place, early voting location, or mail-in ballot location.
What is considered “electioneering”? Campaigning for or against a candidate or ballot issue or question, including discussion of these items. Non-verbal activity is prohibited – such as wearing hats, buttons, T-shirts, etc. that advertise candidates or ballot issues. Soliciting signatures for petitions or ballot issues also falls under the “electioneering” definition.
The Clerk & Recorder’s Office displays “100 Foot Limit” signs to ensure customers, the public and the media are well aware of this law. At the Citizens Service Center, there are signs both inside and outside the building. People visiting any Clerk & Recorder’s Office, not just the Election Department, must adhere to the regulations on electioneering as the “100 foot limit” extends to primary corridors where voters walk to an interior polling place, as well as the room itself and exterior door of the building.
The majority of ballots were mailed on October 15 and each of the Clerk’s branch offices has drop-off ballot boxes; no electioneering will be allowed. When Early Voting takes place, beginning on Monday, October 22 – November 2, the electioneering law will be in effect at those locations as well: Citizens Service Center, the Southeast Clerk & Recorder’s Office, the Citadel Mall and Chapel Hills Mall. On Election Day, at every polling location, the 100 foot limit regulation will be enforced.

NEW 24-HOUR BALLOT DROP BOX
Wednesday, October 17, 2012 – Colorado Springs, CO – The El Paso County Clerk & Recorder has installed a new 24-hour ballot drop box at its Citizens Service Center Main Office. This ballot drop box is the first of its kind in El Paso County. Now voters can simply drive through and drop off the ballot without ever getting out of their car. The ballot drop box is open 24 hours a day, seven days a week.
“I am excited to provide voters another way to quickly and easily drop off their ballot. This ballot drop box is a way for voters to ensure that we receive their ballot during the hours that work for them,” said Clerk Wayne Williams.
Allowing for a 24-hour unmanned ballot drop-off location was provided for by a change in the Colorado Secretary of State rules that now allow for external unmanned drop-off locations as long as they are secured according to the guidance provided by the Secretary of State Rules and under 24-hour video surveillance.
The ballot drop-off is located in the front roundabout of the Citizens Service Center Office at 1675 W. Garden of the Gods Road. There are directional signs to help voters locate the ballot drop box.

BALLOTS MAILED FOR GENERAL ELECTION
Monday, October 15, 2012 – Colorado Springs, CO – The first wave of Mail-In Ballots for the 2012 Presidential Election were mailed today by the El Paso County Clerk & Recorder’s Election Department. Today 202,948 ballots were mailed to the voters of El Paso County who requested a Mail-In Ballot. This number is a 35% increase from four years ago when the County mailed just over 151,000 Mail-In Ballots for the entire election time period.
It is not too late to apply for a Mail-In Ballot if a voter still wishes to request one. The deadline to apply for a Mail-In Ballot is Tuesday, October 30. Voters can sign up for a Mail-In Ballot by one of the three options below.

POLITICAL CAMPAIGN SIGNS INFORMATION
Wednesday, October 10, 2012 – Colorado Springs, CO – With just four weeks before the General Election, political campaign signs are being prominently displayed throughout the county. With both political parties coming together to ask vandals to stop removing political yard signs here is some important information you should know before you pick up and remove that political yard sign.
Most government entities have policies and procedures in place regarding political campaign sign placement and it is up to the campaigns to ensure they follow these directions. Some require permits while others simply provide placement directions.
People are warned against unauthorized removal of political signs from someone else’s property or from a public right of way as there is a $750 fine. During the 45 days before an election through four days after, it is unlawful to remove properly placed political campaign signs from the public right of way (C.R.S. §1-13-113).
The Clerk & Recorder’s Office has compiled information to assist the public and campaigns regarding political campaign signage.
• City of Colorado Springs:
If you would like information on a permit for private usage of public right of
way, contact the City of Colorado Springs Land Use Review Division at 719-385-5355.
• City of Fountain:
Political campaign signs are exempt from some requirements. To learn more,
campaigns may contact the Planning Division for the City of Fountain at 322-2000.
• Town of Monument:
Political campaign signs do not require a permit, however, there are
regulations pertaining to the signs. For information, contact Code Enforcement
for the Town of Monument at 884-8035.
• El Paso County:
For information on permitting of political campaign signs and the timeframe for
placement in unincorporated El Paso County, contact El Paso County
Development Services, Code Enforcement at 719-520-6748.
• Colorado Department of Transportation:
The State of Colorado does not allow political campaign signs on state-owned
property/right of way. Signs may be placed on private property adjacent to the
state highway.
Anyone who has concerns about the placement of political campaign signs should contact one of the following government entities for assistance or to notify them of improperly placed political campaign signs. People should not remove political campaign signs from public right of ways or private property. The only individuals allowed to remove political campaign signs without permission are the owner of the premises, an authorized agent of the owner, or any person charged with enforcement of any state law, ordinance, or regulation.
• City of Colorado Springs:
If you have questions about political campaign signs placed in the City of
Colorado Springs contact CSPD Code Enforcement at 719-444-7891. They will
enforce the regulation of sign placement and will take down signs if placed in
the wrong areas.

TABOR NOTICE FOR GENERAL ELECTION AVAILABLE

Thursday, October 4, 2012 – Colorado Springs, CO – The TABOR Notice (Taxpayer Bill of Rights) for the 2012 General Election in November is now available on the El Paso County Clerk & Recorder’s website. Colorado law requires that prior to each election, a Notice of Election be provided regarding the ballot issues which are regulated by TABOR. The official title is “Notice of Election to Increase Taxes/to Increase Debt/on a Citizen Petition/on a Referred Measure.”
The TABOR Notice contains the ballot issue and the statements in favor of the issue and against the issue. The citizens of the local jurisdictions which placed the issue on the ballot are allowed to provide either arguments in favor or arguments against the measure. The jurisdiction then summarizes all of the citizens’ comments into two five hundred word statements. It should be noted; only those local ballot issues that fall under TABOR regulations are in the Election Notice. Other ballot issues are not included.

Voter Registration Drives can be conducted by various organizations or political parties. The El Paso County Clerk & Recorder’s Office is providing this information so that citizens will be more familiar with Voter Registration Drives. It is important for people to understand how the VRDs function – whether you are a citizen who is approached by a drive to register to vote – or a worker for one of the VRDs circulating voter registration applications.
The Voter Registration Drives are not affiliated with or regulated by the Clerk & Recorder’s Office. The completed voter registration application forms collected by the VRD, however, are turned into the Election Department in the Clerk’s Office for processing. If a person filling out the application resides in a county other than El Paso, the VRD is required by law to turn in the form to that county where the elector resides.
It is acceptable for a worker with a Voter Registration Drive to do “pre-screening” – asking a person which candidate they support or their political party affiliation. And, once completed, the worker is obligated by law to turn the form into the County Clerk’s Office.
How is a Voter Registration Drive regulated? A group that consists of two or more people which both distributes and collects voter registration applications in the state is required to register as a Voter Registration Drive with the Colorado Secretary of State (SOS). A group of two or more people which only distributes the voter applications but does not collect them is not required to register with the SOS.
The person designated as the Organizer for the VRD must complete a training session that includes the laws and rules which apply before the drive may begin. Additionally, training also is required for the people who are circulators for the VRD. The training of the Organizer and circulators of the VRD is to ensure that the voter registration applications will be handled correctly and the process follows the law and SOS rules.
The circulators for the VRD may not be paid per voter registration application, based on the number of applications they distribute or collect. If they are paid, it must be by the hour or by the day.
A standard Colorado Voter Registration Application form is provided to the VRD to use that includes a tear-off receipt. The circulator should be sure that the receipt is completed and then give it to the person who has registered to vote. The voter should keep this as it may be needed when they go to vote.
The Secretary of State maintains a list of approved, registered Voter Registration Drives which is available on the SOS website, http://www.sos.state.co.us/ along with additional information. A written complaint against a VRD may be filed with the Secretary of State if a person believes the VRD has not complied with state statutes or rules.
A voter who registers with a VRD may check their registration at www.GoVoteColorado.com to ensure their registration form has been processed and that all information is correct. This website also can be used by currently registered voters to check their status and update their information.

Monday, September 24, 2012 – Colorado Springs, CO – A sample ballot for the 2012 General Election in November is now available on the El Paso County Clerk & Recorder’s website. The sample ballot includes all elected office races, as well as all questions and issues from the State and local jurisdictions. It differs from actual ballots because the sample includes everything. An actual ballot will have only the races, ballot issues and questions that the voter is eligible to vote on.
The Clerk’s Office provides a sample ballot to give voters the opportunity to become familiar with the candidates, questions and issues prior to receiving their mail-in ballot, early voting or going to the poll place on Election Day. The website address is http://car.elpasoco.com/election then hit the icon for “2012 Election Information”. In addition to the sample ballot, other useful election-related information is on the site.
A limited amount of printed sample ballots will be available soon at each of the Clerk’s four office locations shown below.

FIRST BALLOTS MAILED FOR THE NOVEMBER PRESIDENTIAL ELECTION
MILITARY AND OVERSEAS BALLOTS MAILED
Friday, September 21, 2012 – Colorado Springs, CO – Today the Clerk & Recorder’s Election Department mailed approximately 2,200 Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) ballots for the November 6, 2012 General Election. By law the ballots must be in the mail no later than the 45th day before the General Election. These ballots are the first ballots to be mailed in preparation for this year’s November General Election.
Military and overseas voters can still register and apply for a mail-in ballot. The deadline to apply for a mail-in ballot is Tuesday, October 30, 2012. The deadline to register to vote is Tuesday, October 9, 2012. Voters must be registered 29 days prior to Election Day in order to participate. They can register and apply for a mail-in ballot online at GoVoteColorado.com or by contacting the Election Department by email at uocava@elpasoco.com for forms and assistance. In addition to receiving ballots by mail, military and overseas voters also can select to receive their ballots by email, or fax. They can also access their ballot online with an encrypted link to their ballot. They are able to print their ballot and additional necessary return materials. They then can vote and return their ballot by mail, fax or email to the Clerk & Recorder. This system has improved the voter’s ability to quickly access and receive a ballot, which increases their level of participation in the election process.
In 2010, the law was changed to allow county clerks to mail ballots early to military and overseas citizens to allow them additional time to receive and return their ballots. Overseas military and citizens also are allowed an additional eight days after the election for the Clerk’s office to receive their ballot. Their ballot must be postmarked by Election Day but can be received up to eight days after the election and still be counted. These are the only ballots that a postmark is counted as valid.

The young lady in this video is not an employee of the Clerk & Recorder’s Office and her statements regarding working for the County Clerk’s Office are inaccurate. The El Paso County Clerk & Recorder's Office does not conduct partisan voter registration drives and it is not affiliated with any partisan voter registration drive. All registration forms obtained by such voter registration drives, however, must be submitted to the Clerk & Recorder, which may be why the young lady made the error. “The statement made in this video is both unfortunate and inaccurate. My office does not and will not engage in partisan voter registration. It is the duty of the Clerk’s office to ensure that elections are conducted in a fair and honest manner, this includes allowing any one to register to vote regardless of their political party affiliation," said Clerk & Recorder Wayne Williams. Ouroffice has reached out to the campaign involved and requested that they clarify this information with their volunteers. CLERK & RECORDER SENDS MAIL PIECE TO EARLY VOTERS
Friday, September 14, 2012 – Colorado Springs, CO – In an effort to create a better voting experience, provide easier access to a ballot, and reduce the lines at early voting and at polling places, the Clerk & Recorder developed a mail piece and sent a Mail-In Ballot application to previous early voters.
This mailing also should prove to be a cost savings for the County. Since it will be mailed early enough that those who respond will be included in the County’s first mailing of Mail-In Ballots for the 2012 General Election this is less expensive than when the Election Department prints the ballot in-house.
The Clerk & Recorder’s Office felt that communicating with early voters was an important part of their duty to provide easier access to the ballot. In 2008 the Clerk & Recorder’s Office had unprecedented turnout at the early voting locations and extremely long lines during the last three days.
“Our office wants to ensure that every voter knows their option for voting. Unfortunately, long lines can deter someone from casting their ballot. We wanted to provide information on other alternatives than early voting,” said Wayne Williams, County Clerk & Recorder.
The Clerk & Recorder in the past has mailed Mail-In Ballot applications to all registered voters encouraging them to sign up to be a Permanent Mail-In Voter. This mailing was designed to target a smaller universe as well as be a cost savings to the taxpayers. In 2008 the Clerk’s Office spent over $50,000 mailing Mail-In Ballot applications and this mailing cost $14,569.
In addition to this mailing the County Clerk mailed Voter Information Cards to all registered voters last week. This mailing also included a Mail-In Ballot application as well as polling place and early voting information. “Our goal is to ensure that our citizens are informed of their options for voting and they have all of the necessary information to make the best choice when casting their ballot,” said Williams.

STATEMENTS ON COUNTY TAX ISSUE ON NOVEMBER BALLOT DUE SOON
Thursday, September 13, 2012 – Colorado Springs, CO – Eligible voters in El Paso County may submit their statements regarding Issue 1A on the November Ballot to the Clerk & Recorder’s Office by 5:00 p.m. on Friday, September 21, 2012. Issue 1A, if passed, would increase the County’s Sales and Use Tax rate by twenty-three hundredths of one cent ($0.0023) per dollar. The revenues generated from the Sales and Use Tax increase would be used to fund urgent public safety needs identified by the El Paso County Sheriff.
Voters may express their views in support of, or in opposition to, this proposed tax increase by submitting in written format their statements to the Clerk & Recorder’s Office. From these statements, the Clerk then will write summaries – one for the proposal, and one against – each being no more than 500 words. The summaries will not mention names of persons or private groups, nor any endorsements of or resolutions against the proposal. The Clerk’s summaries will be printed in the ballot issue notice.
People submitting statements to the Clerk & Recorder’s Office must live in El Paso County, be eligible to vote, include their signature and address where they are registered to vote. Statements must be received by the deadline; mail postmarked September 21 but not received will not be considered.

ELECTION JUDGES NEEDED FOR PRESIDENTIAL ELECTION
SEVERAL POSITIONS FOR REGISTERED DEMOCRATS
Friday, September 14, 2012 – Colorado Springs, CO – Citizens are encouraged to become involved in the democratic process as our country prepares to elect a President, by working as an Election Judge for the General Election on November 6.
The El Paso County Clerk & Recorder’s Office will hire over 1,200 Election Judges to work at the 111 polling places throughout the county. According to Colorado law, the selection of Election Judges began with sign-up sheets at the political party caucuses earlier this year. About 625 of the Judges needed were signed up through the caucus process; however, more are needed. Applications are being accepted now.
For these Election jobs, the law dictates there must be a person of each major political party to ensure fairness and balance in the Election process. There is a greater need for people who are registered Democrats to fill vacant Election Judge positions at this time. There also are positions open for registered Republicans.
To qualify for an Election Judge position, a citizen must be 18 years or older, registered to vote in El Paso County, have dependable transportation, and work any duty assigned. Election Judges receive $100 for working on Election Day, November 6. They also are required to attend a training session, for which they will be paid $40.
On Election Day, all Judges must be at their assigned polling place at 5:45 a.m. Polls are open 7:00 a.m. – 7:00 p.m. Judges remain at the polling place throughout the day, until all assignments are complete, which may be until 8:00 p.m. or later. Some responsibilities of Judges include: verifying the voter’s ID, demonstrating how to vote on the touch screen, and issuing provisional ballots.
High School students may apply for Student Judge positions and gain great experience during this exciting Presidential Election year. A Student Judge must be a U.S. citizen, 16 years of age or older and a Junior or Senior in a public or private school, or equivalent if home schooled. The rate of pay is the same as for all other Election Judges and they perform the same duties. Student Judges also must attend a training session prior to the Election, provide their own transportation to the polling place, and be absent from school on Election Day.

VOTER INFORMATION CARDS MAILED
FOR THE NOVEMBER GENERAL ELECTION
Tuesday, September 11, 2012 – Colorado Springs, CO – In order to help voters prepare for the upcoming Presidential Election the El Paso County Clerk & Recorder has mailed Voter Information Cards to all registered voters well in advance of the statutorily required deadline. In an effort to clarify information for voters the Clerk’s Office is mailing three types of voter information cards:
• Permanent Mail-In Voters-this card informs the voter that they will be receiving a ballot by mail, the approximate date they should receive their ballot, the available ballot drop-off locations and the dates for dropping off their ballot.
• Inactive Voters-this card informs the voter that they are inactive and encourages them to verify and update their information. The card also serves as a Mail-In Ballot application so they can update their information and request a Mail-In Ballot. It also includes information regarding the voting options for the 2012 Election (Early Voting, voting by mail, and their 2012 Polling Place location).
• Active Voters-this card informs the voter of their options for voting in this November’s election (Early Voting, Mail-In Ballot or at their Polling Place), a Mail-In Ballot application as well as their 2012 Polling Place.
There are three ways that voters can return their Voter Information Cards, if they are updating their information or requesting a Mail-In Ballot:
1. Go online to GoVoteColorado.com (requires a valid Colorado Driver’s License or ID).
2. Return the completed Voter Information Card to the Clerk’s Office by mail, fax or email.
3. Come into one of the four Clerk & Recorder’s Office locations.
Information on Voter Registration Statuses:
• Permanent Mail-In Voters-These are voters who have signed up to always receive their ballot in the mail. The Clerk’s Office mails their ballot to them for every election as long as they stay active or remain on the list.
• Inactive Voters-Any registered voter who failed to vote in the 2010 General Election was changed from “active” to “inactive”. The individual remains registered to vote and eligible to vote but, the voter is no longer considered active. Notice was sent to all affected individuals in February of 2011. Also included in the list of Inactive Voters are individuals whose mail has been returned to the Clerk’s Office as undeliverable.
• Active Voters- Are registered voters whose information appears to be current and whose mail has not been returned to the County Clerk’s Office as undeliverable.

NEW SERVICE OFFERED FOR BOCC RECORDS
Tuesday, September 4, 2012 – Colorado Springs, CO – Access to Resolutions approved by the El Paso County Board of County Commissioners is now readily available through the County website at http://www.elpasoco.com/. The Board acts on governance matters through a Resolution process at the weekly BOCC meetings. The minutes of the meetings are recorded and posted on the County website.
Anyone visiting the site can choose the date of the meeting, read the minutes and click the link of the Resolution in which they are interested. The link opens the recorded Resolution document. BOCC meeting minutes on the web are for the years 2012 and archived years 2011 – 2005. The meeting information is located on the County website at http://bcc2.elpasoco.com/bocc/agenda.asp. Also included is the audio record of BOCC meetings for those who wish to hear the proceedings and discussion of the topics. The audios have file markers to easily find agenda items.
Previously, only the minutes for the current year had active links to the recorded Resolutions. This new service will assist people who wish to research Resolutions brought before the County Commissioners in past years. The Clerk to the Board of County Commissioners Department, in the Clerk & Recorder’s Office, maintains the records of the BOCC. The departmental staff may be contacted for assistance at 520-6430.

ELLICOTT SCHOOL DISTRICT RECALL PETITIONS DECISION ON PROTESTS
Friday, August 31, 2012 – Colorado Springs, CO – A Protest Hearing regarding the Recall Petitions for two Ellicott School District 22 Board members, MaryAnna Clemons and Ernest Hudson, was held on August 15. El Paso County Clerk & Recorder Wayne Williams has determined a ruling on the protests.
Three protests had been filed: MaryAnna Clemons and Ernest Hudson each filed a protest on their own behalf. Gary Dahn filed a protest in regard to both MaryAnna Clemons and Ernest Hudson.
Clerk Williams denied the protests filed by Gary Dahn and MaryAnna Clemons with regard to the Petition to Recall MaryAnna Clemons from the D-22 School District Board of Directors. The determination is that the MaryAnna Clemons Recall Petition has been found to be sufficient.
In the protest filed by Gary Dahn regarding the Recall Petition for Ernest Hudson, it was ruled that Mr. Dahn did not meet his burden to sustain his protest.
Clerk Williams did grant the protest filed by Ernest Hudson with regard to the Petition to Recall Ernest Hudson from the D-22 School District Board of Directors. The determination is that the Ernest Hudson Recall Petition has been found to be insufficient.
As a result of these protest rulings, there will be Recall Election held in conjunction with the General Election on November 6, 2012. The Recall Election will be for Ellicott School District 22 School Board member MaryAnna Clemons.

LIFE OF A MAIL BALLOT What Happens after you Place Your Mail Ballot in the Mail Box
Tuesday, August 21, 2012 - Colorado Springs, CO - In November, over 158,000 El Paso County voters will cast their ballot by mail. Many often wonder if their ballot will count and what happens to their ballot after they drop it in the mail. In an effort to clarify this matter and boost voter confidence the El Paso County Clerk & Recorder’s Office has produced a short video on what happens to a mail ballot after it is received by the El Paso County Election Department.
“Our office wanted to provide clarity regarding mail ballot processing. This video highlights the processes and the measures we take to not only protect voters’ privacy but also to ensure that every vote is counted in a fair and accurate manner,” said Clerk Wayne Williams.

August 3, 2012 – Colorado Springs, CO – The El Paso County Clerk & Recorder has issued an open call for nominations for successor candidates on behalf of the Ellicott School District for their potential recall election. Should the sufficiency of the recall petitions stand after the time for protest has passed and based on the determination of any protest hearings the recall election will move ahead. It is anticipated this recall election will be held in conjunction with the General Election on November 6, 2012.
Because the time for the protest period has not yet closed the due date for completed petitions has not yet been set. By law the completed successor candidate petitions must be filed with the El Paso County Clerk & Recorder’s Office no later than ten calendar days after the Designated Election Official sets the date for the election. The official date of the election will not be set any earlier than August 15, 2012, making the deadline no earlier than August 25, 2012.
“Even though the time for the protest period has not yet closed and our office has not yet officially selected the date of the election we wanted to give those who want to potentially fill these positions every available opportunity to circulate their petitions instead of waiting and giving them only ten days to circulate their petitions,” said Clerk Wayne Williams.
Any individual who wishes to be a successor candidate for one of the two offices up for recall may pick up a petition packet and instructions at the El Paso County Clerk & Recorder’s Main Office at 1675 W. Garden of the Gods Road, Suite 2202. Individuals circulating a petition to be a successor candidate must collect fifty valid signatures by the deadline.

July 20, 2012 – Colorado Springs, CO – The El Paso County Clerk & Recorder’s staff will be at the El Paso County Fair providing citizens with the opportunity to register to vote for the upcoming November Presidential Election.
The Clerk & Recorder’s Office will be working in conjunction with El Paso County and the Citizen Outreach Group to have voter registration available at the County booth at the fair. Clerk & Recorder’s staff will be at the booth to assist voters and answer questions from 11:00 a.m. to 6:00 p.m. every day of the fair, July 21 – 28.
“We wanted to be proactive in providing our citizens an opportunity to register to vote and be able to participate in this monumental election,” said Wayne Williams, Clerk & Recorder.
The deadline to register to vote for the November Presidential Election is Tuesday, October 9, 2012.
July 9, 2012 – Colorado Springs, CO – Friday the El Paso County Election Department completed the required canvass process to certify and finalize the 2012 Primary Election results. The canvass process is the official audit of the election results. The canvass board is made up of a member of each major political party and the County Clerk & Recorder.
Part of finalizing the election results is completing the required Post Election Audit. This audit is a comparison of the tabulated results to a hand count. The races are randomly selected by the Secretary of State’s Election Division. In the case of El Paso County, for every race the machine and hand count matched.
Additionally, UOCAVA ballots that were returned by Military and Overseas Citizens voters and were postmarked by Election Day will be counted and added into the results. Other ballots that will be included in the final count are ballots where the voter needed to cure their ballot before it could be counted. There are several reasons for this; for example their signature did not match their voter record, and they needed to provide identification and confirmation that they did return their ballot, or they did not sign their ballot. Individuals with these types of situations have until eight days after the election to respond and correct the problem in order to have their ballot counted.

June 25, 2012 – Colorado Springs, CO – For voters who have been displaced by the Waldo Canyon Fire and who still need to cast their ballot in the June 26 Primary Election, the El Paso County Clerk & Recorder will issue them a replacement ballot. Voters just need to appear in person at the Clerk’s Office and the staff will assist them with the process for receiving a ballot. If the voter cannot appear in person, please contact the Election Department and the staff will work with individuals on a case by case basis to get them a ballot.
Voters can come to any one of the four Clerk & Recorder’s Offices to receive a mail ballot.
The Clerk & Recorder’s branch offices are:
o Main – Citizens Service Center – 1675 W. Garden of the Gods Road
o North – 8830 N. Union Blvd (Research Pkwy and Union Blvd)
o Southeast – 5650 Industrial Place (Powers Blvd and Airport Rd)

June 25, 2012 – Colorado Springs, CO – Tomorrow is Election Day. Voters who wish to vote in the 2012 Primary Election must return their ballot by 7:00 p.m. on June 26 to the El Paso County Election Department in order for the ballot to be counted. Ballots that are postmarked June 26 but are not received by 7:00 p.m. on Election Day by the Clerk & Recorder will not be counted.
The Clerk & Recorder’s Offices will be providing curbside ballot drop-off at all four branch locations tomorrow from 7:00 a.m. to 7:00 p.m. No neighborhood polling places will be open on Election Day. Registered voters who have not received a mail ballot can come to any of the four Clerk & Recorder’s Offices to pick up a ballot or to vote in person. All offices will be open 7:00 a.m. to 7:00 p.m.
